Although NDA is a contract and it is legally binding, but breaking or violating is not always as high as a crime. However, if an NDA is violated with a purpose of theft or insider trading then no doubt its a crime which you shall be punished for.
The federal EEA makes it a crime to take, copy or receive the trade secrets without the approval of owner. Although sharing a trade secret is a crime whether or not you have signed an NDA.
